1. Terms & Conditions

1.1 Use of Our Website

By using this site, you represent that you are at least 18 years old or have permission from a parent or guardian. Parents who allow minors to use this site agree to be bound by these Terms and are responsible for the minor's actions You agree not to use our products or services for any unlawful purpose. By placing an order, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, including all representations, warranties, and indemnification obligations regarding uploaded Content.

1.2 Products & Custom Orders

We sell physical products which are custom-made based on content uploaded by customers. Because our products are handmade and made to order:

• All custom items are final sale

• We are not responsible for errors caused by customer-provided content

1.3 User-Uploaded Content

By uploading images, text, or other materials (“Content”), you represent and warrant that:

• You own the Content or have full legal rights to use it

• The Content does not infringe on any copyright, trademark, or intellectual property rights

• The Content does not include:

  • Copyrighted characters, logos, brands, or artwork without permission

  • Celebrities or public figures

  • Hate speech, threats, harassment, or illegal material

  • Obscene, defamatory, or abusive content

• You grant Park Pouches a worldwide, royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, and display your Content solely for producing your order, providing customer service, and marketing our services (including showcasing example products).

• You acknowledge that uploading copyrighted material without authorization may violate federal and state laws

• You understand that we rely on your representations and do not pre-screen all uploaded Content

• You accept full responsibility for any copyright infringement claims resulting from your uploads

1.3A DMCA Notice and Takedown Procedure

Park Pouches complies with the Digital Millennium Copyright Act (DMCA). If you believe Content uploaded by a user infringes your copyright, please send a written notice to info@parkpouches.com containing:

• Identification of the copyrighted work

• Identification of the infringing material and its location

• Your contact information

• A statement of good faith belief that use is unauthorized

• A statement under penalty of perjury that the information is accurate

• Your physical or electronic signature

We may remove and/or cancel orders using allegedly infringing Content without prior notice and may terminate orders of repeat infringers.

1.4 Right to Refuse or Cancel Orders

We reserve the right, at our sole discretion, to:

• Review uploaded Content

• Refuse, cancel, or refund any order

• Remove or reject Content that violates these policies

Orders containing prohibited or questionable Content may be canceled without notice.

1.4A No Monitoring Obligation

We do not and cannot pre-screen, monitor, or review all Content uploaded by customers. While we may review Content at our discretion, we have no obligation to do so. The fact that we produce an order does not constitute approval, endorsement, or verification that Content is lawful or non-infringing. Customers are solely responsible for ensuring their Content complies with all applicable laws.

1.5 Intellectual Property Indemnification

You agree to indemnify and hold harmless Park Pouches, its owners, and affiliates from any claims, damages, losses, or legal expenses arising from Content you upload, including intellectual property claims.

You agree to indemnify, defend, and hold harmless Park Pouches, its owners, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (INCLUDING REASONABLE ATTORNEY FEES AND LEGAL COSTS) arising from or related to:

• Content you upload or provide

• Your violation of any intellectual property rights

• Your violation of these Terms & Conditions

• Any claim that your Content infringes on third-party rights

This indemnification obligation survives termination of your order and these Terms.

1.6 No Government Affiliation or Endorsement

Park Pouches is an independent business and is not affiliated with, endorsed by, sponsored by, or approved by the United States Government, the National Park Service, the Department of the Interior, or any national park. Any references to national parks, park names, or related imagery are used solely for artistic, descriptive, or educational purposes.

1.7 Donations

If we advertise that a portion of proceeds will be donated to charitable or nonprofit organizations:

• Donations are made by the Company at its discretion

• Percentages are calculated based on net proceeds, not gross revenue

• Donations are not made on behalf of individual customers

1.8 Shipping & Delivery

Production and shipping timelines are estimates and not guaranteed. We are not responsible for carrier delays, lost packages, or delivery issues once an order has shipped. Risk of loss passes to the customer upon shipment.

1.9 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION

• SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU

1.10 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

1.11 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

1.12 Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Park Pouches regarding your use of our services and supersede any prior agreements.
